1. Agreement to Terms

By accessing or using the services of Cybernex Auto LLC ("Cybernex Auto," "we," "us," or "our"), including the website at cybernexauto.com and our fleet management platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Services

Cybernex Auto provides vehicle rental and leasing services for rideshare and personal use in the Chicago metropolitan area. Our fleet management platform enables operators to manage vehicles, customers, payments, maintenance, and compliance.

3. Eligibility

To rent a vehicle from Cybernex Auto, you must:

• Be at least 21 years of age
• Possess a valid U.S. driver's license
• Meet our driver qualification requirements
• Provide proof of insurance as required
• Pass our application review process

4. Rental Agreements

All vehicle rentals are governed by individual rental/lease agreements executed between you and Cybernex Auto. These Terms of Service are supplementary to your rental agreement. In the event of a conflict, the rental agreement shall control.

5. Payments

Rental payments are due weekly as specified in your lease agreement. We accept payments via credit/debit card (processed by Stripe) and Zelle. Late payments may incur fees as outlined in your rental agreement. All amounts are in U.S. dollars.

6. Vehicle Use

Rented vehicles must be used in accordance with:

• All applicable federal, state, and local laws
• Illinois traffic and vehicle regulations
• The terms of your rental agreement
• Rideshare platform requirements (if applicable)

You are responsible for all tolls, traffic tickets, and parking violations incurred during your rental period.

7. GPS Tracking

All fleet vehicles are equipped with GPS tracking devices. By renting a vehicle, you consent to location tracking during the term of your rental for fleet management, safety, and theft prevention purposes.

8. Limitation of Liability

To the maximum extent permitted by Illinois law, Cybernex Auto shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or rental of our vehicles.

9. Governing Law

These Terms of Service are governed by the laws of the State of Illinois. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Cook County, Illinois.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the revised terms.
